Non Availability of Birth Certificate (NABC)

INTRODUCTION:

Every birth whether at Hospital or at home is to be reported and registered within a prescribed time period at the office of concerned registrar of births and deaths. Birth certificate is a vital document which records the birth of a person and is used as a supporting document for the issuance of other important documents like Passport, OCI etc.

In some cases where the Birth was not registered due to some reasons, the person can apply for NABC (Non Availability of Birth Certificate) from the concerned office.

It is an official statement stating that the birth record of particular person is not available. Section 17 of the Registration of Births and Death Act, 1969 provides for this provision that birth record of the particular person is checked and it is not available in the register. It is the legal document that certifies the registration of unregistered birth. And till the time a person does not have birth certificate NABC will fulfill the requirement and is considered "as good as a birth certificate".

AUTHORITIES EMPOWERED TO ISSUE THE CERTIFICATE:

  • In Urban Areas: The Municipal Corporation of the zone in which a person was born has been assigned this work of issuance of birth certificate.
  • In Rural Areas: Para-medical staff is there in every village that has been authorized for the issuance of certificate. And the Tehsildar at the Taluka level is also authorized to issue this certificate. And the person could also visit the Gram Panchayat Office in his village and get the certificate from there.
  • For Non-resident Indian: Such NRI’s born before 1969 when the registration rule came into effect the Indian consulates can issue the NABC certificate.

ELIGIBILITY CRITERIA & DOCUMENTS:

Every state in India may have different eligibility criteria for the issuance of NABC. For example in Delhi if a person satisfies below three conditions, he/ she becomes eligible for a NABC:

  • An individual who is a citizen of India or an NRI, born within the territorial jurisdiction of NCT of Delhi.
  • Individual shouldn’t have any Birth Certificate issued from any Government agency anywhere in India.
  • There should be a gap of minimum one year between the date of birth of the individual and the date of making.

Similarly, list of documents may also vary from region to region.

Generally following documents are submitted for the purpose which acts as Identity and address proof:

  • Aadhar Card
  • Pan Card, Passport
  • Voter ID Card
  • Ration Card etc.

For date of birth proof documents like

  • Passport
  • Nursing home/Hospital Report/Vaccination card
  • SSC from recognized board by GOI
  • Certificate from School signed by Principal on School Letter Head can be used
  • An affidavit is also required from the applicant along with the application

PROCEDURE:

It is important to first conduct a search at the concerned birth registrar office to verify indeed there is no record of birth available. Once it is confirmed that the birth record is not available then an application along with supporting documents can be made at the concerned office. The registrar will grant the NABC after verification of the application.
